These Terms of Service ("Terms") are the agreement between you and Health by Habit ("HBH," "we," "us") covering your use of healthierbyhabit.com, the HBH paid subscriber app, the Drive Habit App, The Helm, The Galley, The Bunkhouse, the Workout Tracker, and any related services (together, the "Services").
By creating an account, subscribing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. By creating an account, you confirm you are 18 or older.
2. Your account
You are responsible for the email address and password tied to your account, and for all activity that takes place under it. If you suspect unauthorized use, contact alan@rewire-reset.com immediately.
You agree to provide accurate information at signup and to keep it current. We may suspend or close accounts that contain inaccurate information or that are used in violation of these Terms.
3. Subscription terms
3.1 Plans
HBH offers monthly, annual, and founding-member subscription plans. Current pricing and what each plan includes is shown on the subscribe page.
3.2 Billing
Subscriptions are processed through Stripe and billed in advance on a recurring basis:
- Monthly plans renew every month on the date you subscribed.
- Annual plans renew every 12 months on the date you subscribed.
- Founding-member plans lock in your rate for as long as you remain a continuous subscriber. If your subscription lapses, the founding rate is forfeited.
You authorize us, through Stripe, to charge your payment method automatically at each renewal.
3.3 Cancellation
You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period. You keep access until then.
3.4 Refunds
All subscription fees are non-refundable, except where required by law. If you cancel mid-period, you retain access until the period ends. No partial refund is issued for the unused portion. Special cases such as a technical failure on our side or an accidental double charge are handled on request.
3.5 Price changes
We may change subscription pricing. If we do, we will notify you by email at least 30 days before the change takes effect. Founding-member rates do not change as long as the subscription stays continuous.
3.6 Taxes
Listed prices do not include sales tax, VAT, or similar charges. Where required, those are added at checkout.
4. Free assessment, content, and trial features
Parts of the Services are free, including the HBH Assessment, the Six Moves one-pager, the Weekly Brief newsletter, and the public blog. We may change or remove free features at any time.
If we offer a free trial of a paid feature, the terms of that trial will be shown at the time you start it. Unless stated otherwise, the trial converts to a paid subscription unless you cancel before it ends.
5. License to use the Services
Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to access and use the Services for your own personal use.
You may not:
- Resell, sublicense, or commercially exploit any part of the Services.
- Copy, reproduce, or redistribute HBH content (the book, the framework, recommendations, archetypes, written content, video, audio) except as expressly permitted.
- Reverse engineer or attempt to extract source code from the Services.
- Scrape, harvest, or systematically download content.
- Use the Services to train a machine learning or AI model without our prior written consent.
- Use the Services in any way that violates applicable law or these Terms.
6. Your content
You may submit content to the Services, including habits, routines, journal entries, recipes, goals, project notes, and reach-out lists ("Your Content").
You retain ownership of Your Content. By submitting it, you grant us a worldwide, royalty-free license to host, store, display, and process Your Content as needed to provide the Services to you.
The Galley includes a community recipe pool. Recipes you upload are shared with other HBH members by default. You can mark any recipe private at upload or any time after, and private recipes appear only on your own meal plans. We use shared recipes only to power the community pool. We do not sell them, license them to third parties, or use them for advertising.
By sharing a recipe, you grant us and other HBH members a worldwide, royalty-free license to view, save, cook from, and rate the recipe inside the Services. Shared recipes carry attribution by first name and last initial. You can switch any recipe to private or delete it at any time, and either action removes it from the community pool immediately.
Uploaded recipes also run through an AI tagging step that estimates macros, calories, and dietary tags, and a safety and brand scan that filters out content failing food-safety or community standards. AI tags are best estimates and not nutrition labels. See the Privacy Policy §5 for full detail on the recipe pool.
You are responsible for the legality of what you submit. Do not upload anything that infringes someone else's copyright, that is unlawful, or that contains another person's private information without their consent.
7. Acceptable use
You agree not to use the Services to:
- Harass, threaten, defame, or harm anyone
- Impersonate any person or organization
- Upload viruses, malware, or other harmful code
- Interfere with the security or stability of the Services
- Bypass any access control, paywall, or rate limit
- Use the Services for any illegal purpose
We may suspend or terminate accounts that violate these rules.
8. Third-party services
The Services connect to third-party services including Stripe (payments), Supabase (database), Nimble (CRM and email), Vercel (hosting), Oura Health (wearable data), and AI providers. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.
If you connect your Oura Ring, you are also subject to Oura's terms and privacy policy.
9. Health disclaimer — not medical advice
Read this section carefully. By using the Services you agree to it in full.
The Services provide habit guidance, educational content, and tools for tracking and improving health-related behaviors. The Services are not medical advice and are not a substitute for professional medical care, diagnosis, or treatment.
Recommendations surfaced inside The Bunkhouse, The Helm, The Galley, the assessment, the recommendation library, and any written or AI-generated content are general habit guidance, drawn from public health research, books, and HBH's own framework. They are not a diagnosis. They are not a treatment plan. They are not personalized medical advice.
You should always consult a qualified physician before:
- Starting or changing any exercise or training program
- Starting or changing any dietary plan, including elimination or fasting protocols
- Starting, stopping, or changing the dose of any supplement, vitamin, herb, medication, or sleep aid
- Acting on any reading from the Oura Ring or any wearable, especially if it suggests a heart, sleep, or recovery concern
- Making any health decision when you have a chronic condition, take prescription medication, or are pregnant or trying to become pregnant
If you experience symptoms that may be serious, seek qualified medical care immediately. Do not use the Services as a substitute for emergency medical advice.
The Services may surface educational content discussing supplements, alcohol, sleep, exercise, stress, breathing practices, and similar topics. Any specific products or protocols mentioned are referenced for educational purposes only and are not a recommendation that they are right for you.
10. Wearable data accuracy
If you connect your Oura Ring or any wearable, the data we receive from that device may be incomplete, delayed, or inaccurate. We display this data as a tool for self-awareness, not as a clinical instrument. Do not rely on any reading from the Services for medical decisions.
11. Disclaimer of warranties
The Services are provided "as is" and "as available." To the maximum extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any specific outcome will result from using them.
12. Limitation of liability
To the maximum extent allowed by law, in no event will Health by Habit, its owners, employees, contractors, or affiliates be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising out of or related to your use of the Services.
Our total liability to you for any claim arising out of or related to the Services is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow some of these limitations. Where that is the case, the limitations apply to the maximum extent allowed.
13. Indemnification
You agree to defend, indemnify, and hold harmless Health by Habit, its owners, employees, and contractors from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Services, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party right.
14. Termination
We may suspend or terminate your account at any time if you violate these Terms or use the Services in a way that creates risk for us or for other users. We may also terminate the Services or any part of them at any time, with reasonable notice where practical.
You may close your account at any time from settings. On termination, your right to use the Services ends. We will retain certain records as set out in the Privacy Policy.
15. Changes to these Terms
We may update these Terms as the Services evolve. When we make material changes, we will update the "Last updated" date above and notify subscribers by email. Continued use of the Services after the change takes effect means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The seat of arbitration will be Wilmington, Delaware. Each party will bear its own attorneys' fees, except as allowed by law.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
17. Entire agreement
These Terms and the Privacy Policy form the entire agreement between you and Health by Habit regarding the Services. They replace any prior agreement on the same subject.
